Kolkata, Sep 18 (PTI) Union Finance Minister Nirmala Sitharaman on Thursday outlined the key features of the Next Gen GST reforms, emphasising that the new tax structure will benefit the people of India, particularly the poor, middle class, farmers, MSMEs, and several key industries in West Bengal.
Sitharaman said that the new GST rates would be implemented from September 22, in time for the Durga Puja which is the biggest festival of the state.
Addressing a GST-related discussion at the National Library's Language Building in Kolkata, she said that the reforms are a comprehensive effort to reduce tax rates, ease compliance, and clear business con

ive of party or affiliation, thanking them for playing a very constructive role, as the people of India need this reduction now,” she said.
“I am happy to say that the determination of September 22 as the implementation date for Next Gen GST was largely influenced by Puja. The Shubh Mangal Diwas when the revamped GST comes into effect coincides with the first day of Navratri, the day after Mahalaya. There is, therefore, a strong influence of Bengal in this decision-making,” she said.
The message from Bengal will go on to inspire the rest of the country, just as it did during the independence struggle and as Bengal has always done in leading the nation, Sitharaman said.

She noted that the new GST structure would bring down taxes on essential goods and promote local craftsmanship.
Sitharaman also pointed out that products like ‘Nakshi Kantha’ (embroidered clothes), Malda's mangoes, Darjeeling tea, jute bags, hosiery, and ready-made garments would directly benefit from the new reforms.
The finance minister expressed optimism that these changes would spur growth across various sectors in the state.
“From small-scale industries to agricultural products, the new GST framework will open up new opportunities in the market, which will also help the state's economy,” she said.

Kolkata, Sep 18 (PTI) Union Finance Minister Nirmala Sitharaman on Thursday said that while the government has moved to rationalise Goods and Services Tax (GST) slabs, the country is “not yet” prepared for a single-rate GST system, though it remains a possibility in the future.
At an event in Kolkata, she underlined that the four-rate GST structure of 5, 12, 18 and 28 per cent was not arbitrarily fixed, but arrived at through a detailed exercise of aligning diverse state-level taxes with the nearest slabs.
“When a review of GST was undertaken, one of the needs identified was that they (GST Council members) didn't want four rates. How

The HC held that a show-cause notice issued to a decedent was void ab initio and that liability for tax of the financial year rested with the decedent's legal representatives under Section 93 of the Act, thereby attracting personal liability of the petitioner as a legal representative (daughter). The Court found that respondent authorities, had they been notified of the decedent's death, would have directed proceedings correctly against the legal representatives; proceeding against the deceased rendered the notice and consequent order nullities. The show-cause notice dated 28.05.2024 and the impugned order dated 29.08.2024 were set aside and quashed, and the petition was disposed of.

Frozen poultry (CTH 0207) for institutions marked 'not for retail sale' exempt from GST with documentary proof of institutional use
Case-Laws
GST
AAR held that supplies of frozen poultry (CTH 0207) sold to institutional or industrial consumers bearing the declaration “not for retail sale,” whether procured directly from the manufacturer, an importer, or a wholesale dealer, constitute supplies for consumption by qualifying institutions and, where supported by a verifiable documentary trail and exclusive non-resale use, fall outside the GST concept of “pre-packaged and labelled” goods and thus qualify for the notified exemption. The ruling is strictly conditional: failure to comply with the statutory declaration, documentary evidence, or diversion to non-institutional/retail use means the goods retain the character of pre-packaged labeled frozen meat and attract GST at 5% under the relevant rate notification.

AAR held that the applicant's activities constitute intermediary services within the meaning of Section 2(13) of the IGST Act, 2017, rather than independent consultancy (marketing, recruitment or referral) or provision of education. The applicant merely facilitates the supply of education by foreign universities to Indian students, earning commission contingent on successful admissions, and lacks strategic autonomy or expert-driven consultancy functions. Consequently the applicant supplies services as an intermediary, with place of supply located in India under Section 13(8)(b); therefore the services do not meet the statutory criteria for export of services under Section 2(6) and are taxable under the IGST regime.

AAR holds that the quit rent paid to the State via the Forest Department for leased agricultural land constitutes consideration for a leasing service and is classifiable under SAC 9986 (renting or leasing of vacant land), not under SAC 9972 (real estate services). Consequently, the lease rent collected by the Government for agricultural land through the Forest Department falls within the exemption scope of Entry No. 54 of Notification No. 12/2017-Central Tax (Rate) and is exempt from GST. The ruling concludes the payment is a taxable service by classification but, as applicable, is relieved from tax liability by the specified exemption entry.

Consequently, the petitions were allowed and the matter remitted for reconsideration by the appellate authority.

IGST-paid imports allowed ITC despite payment after 180 days; no reversal under Section 16(2) and Rule 37
Case-Laws
GST
The AAR held that the applicant is entitled to claim input tax credit of IGST paid on import of goods even where payment to the foreign supplier was deferred beyond 180 days from invoice but made within FEMA/RBI timelines. The Authority concluded that such ITC remains admissible under Section 16 of the CGST Act, 2017 and is not liable to reversal under the second proviso to Section 16(2) read with Rule 37, since IGST was discharged at customs thereby protecting revenue and creating a situation analogous to reverse charge supplies (which fall under the proviso's exclusion). The decision rests on legislative intent reflected in GST Council recommendations.

Charges for deposit works deemed incidental to transmission, qualifying for exemption under Entry 25A of Notification 12/2017
Case-Laws
GST
The AAR upheld that charges recovered by the applicant from consumers for deposit work (material and erection charges, pro-rata charges, supervision charges, proportionate line charges, registration fees) constitute incidental and ancillary activities to the principal supply of transmission of electricity. Relying on dictionary definitions and prior SC authority recognizing services as incidental when subordinate or appertaining to a primary activity, the AAR found these deposit works necessary for efficient intra-state transmission and thus integrally connected to the applicant's statutory transmission function. Consequentially, such charges qualify for exemption under Entry No. 25A of Notification No.12/2017 as amended by the later notification.

However, the petitioner was issued a notice under section 74 of the GST Act for wrongfully availing input-tax credit on the ground that the registration of the other firm was cancelled. A detailed reply was filed by the petitioner and it was rejected. The appeal filed by the petitioner was also rejected.
The petitioner pleaded that the GSTR-3B of the supplier reflected that it had deposited the tax on the transaction with the petitioner. It was pleaded that all material supporting the transaction was also produced before the authorities concerned a

New Delhi, Sep 17 (PTI) Union Home Minister Amit Shah slammed the Congress on Wednesday, accusing the opposition party of organising the “Ghuspaithiya Bachao” yatra to “protect infiltrators” in a bid to win elections with their support.
Shah was speaking at the Thyagaraj Stadium here. He inaugurated 17 public-welfare schemes of the Delhi government on the occasion of Prime Minister Narendra Modi's 75th birthday.

The Congress and other opposition parties have alleged that the exercise is aimed at depriving people of their right to vote.
Shah also announced the inauguration of the Narela-Bawana Waste-to-Energy Plant in Delhi that will process 3,000 tons of waste, alongside the Okhla plant handling 2,000 metric tons, to generate electricity, boosting the circular economy and green energy.
He said the Modi government is going to generate electricity from the massive garbage mounds that once shamed the people of Delhi.
The home minister said regardless of the party that governed the national capital, Modi always provided more than what was due, without any discrimination.
